Question:

Massachusetts lemon law (as-is)?

Heather - 2009-02-26 15:29:00 - Buying Selling

I live in mass, and bought a car "as-is" from a private party. They told me several times that there was absolutely nothing wrong with it. I've had it looked at since (couldnt get it inspected at the time b/c we had no plates it was un-registered), and it needs all new braking systems, a new tranny, and if i engage the alarm system on the car overnight, it will not start up in the morning. Since I bought the car as-is, is the lemon law still in effect???

Best Answer:

Lemon laws protect the buyers of NEW vehicles from serious, recurring defects. Lemon laws don't apply to used cars, and never in a private sale. As is means as is - you bought the car and all its problems. Sorry.

Sorry but lemon laws only apply to brand new cars, not used cars. Unfortunately, you bought the car "as-is" without guarantees, warranties, or return rights.

You could have called a mobile mechanic over to inspect the car before buying. You failed to plan. That's all. Are used cars covered under Massachusetts Lemon Law? Yes. Used vehicles that are purchased in the Commonwealth come with express warranties. If the vehicle has has less than 40,000 miles, the express warranty is 90 days or 3,750 miles from date of purchase. If mileage is between 40,000-80,000, the warranty period is 60 days or 2,500 miles. If the mileage is between 80,000 miles and 125,000 miles, the express warranty is 30 days or 1,250 miles. If the consumer has the same defect three times during the express warranty or if the car is in the shop 10 cumulative business days (Monday-Friday) during this period, the consumer is entitled to a full repurchase, minus a mileage offset of $0.15 a mile.

The guy who quoted the MA Lemon Law conveniently posted only part of the law. The part that actually impacts you says this: What vehicles are not covered under the Massachusetts Lemon Law? The following vehicles are not covered: auto-homes; vehicles built primarily for off-road use, vehicles used primarily for business purposes; vehicles with defects caused primarily by owner negligence, accidents, vandalism, or unauthorized repairs by someone other than the manufacturer-authorized dealership. Brakes, tranny issue, Alarm - are all owner negligence, lack of maintenance, and improper installation. You are out of gas, and you own the car and its problems.
